Personal Injury
The majority of members engage in personal injury related work including representation of parties at Fatal Accident Inquiries and claims involving industrial accident/disease, catastrophic injury, clinical negligence, liability of air carriers, road traffic/MIB litigation, offshore accident, occupational stress, duties of local authorities and occupier's liability.
Members regularly appear in all courts (the Sheriff Court, Court of Session and House of Lords). Our members have considerable experience of appearances in civil jury trials, for both pursuers and defenders. Members of Chambers have been involved in many major reported cases in Scotland in recent years.
We are able to provide both a litigation and more general advice service. We encourage instruction in potential litigation at an early stage to seek to limit costs to the clients and ensure settlement on the best terms possible.
Members act for Pursuers and Defenders. The wide knowledge and varied experience of members who practice in this area permits for the provision of a high quality, efficient legal service. Our members regularly deliver seminars in Personal Injury and disease litigation matters throughout the UK, and we have close connections with English Chambers. We are able to provide advice concerning cross border litigation and damages claims in personal injury.
Members take on speculative and legal aid work in appropriate cases. Instructions are accepted in accordance with the recent changes to the Faculty of Advocates' Direct Access Guidelines.
As part of its service, the reparation team publishes bi-monthly e-bulletins keeping practitioners up to date with all developments in the reparation area, click here if you wish to subscribe. For previous editions of the bulletin, click here.
